TipAfter Terms of Service
Effective date: October 18, 2026
These terms are an agreement between you and Tip After LLC, a Virginia limited liability company (“TipAfter,” “we,” “us”), which runs the TipAfter app and website at tipafter.com (the “Service”). By using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Service.
Part A applies to everyone. Part B applies to customers who order food. Part C applies to restaurants. Part D applies to drivers. Part E covers customer accounts, the Top Tippers board, the free restaurant directory, and the waitlist.
Part A: Everyone
1. What TipAfter is
TipAfter is a free directory of local restaurants. At restaurants that have joined, you can order food for pickup or delivery and choose your tip after you get your food, with 100% of tips going to staff. TipAfter is a technology platform. The restaurant prepares and sells the food. TipAfter does not prepare, sell, or inspect food.
2. Pilot and demo mode
TipAfter is a working prototype in a local pilot. Today, tipafter.com runs in demo mode: orders, payments, refunds, and tips are simulated, no real money moves, and no food is prepared or delivered. Restaurants marked “Demo” are samples. Some test versions use Stripe’s test mode with test cards, which also involves no real money. Customer accounts, the Top Tippers board, the free restaurant directory, and the waitlist are available on tipafter.com and store real information you enter, as described in our Privacy Policy. Test versions may also store order records and deals subscriptions. Features, fees, and these terms may change during the pilot.
3. Eligibility
You must be at least 18 (or the age of majority where you live) to pay for an order, to create a customer account, or to sign up a restaurant. The Service is not directed to children under 13.
4. Payments are processed by Stripe
When card payments are on, payments are processed by Stripe, Inc. TipAfter never receives or stores your full card number. Your use of Stripe’s services is also subject to Stripe’s terms and privacy policy. Tip After LLC is the merchant of record for card payments made through TipAfter: Tip After LLC charges your card through Stripe and pays the restaurant (and, for delivery tips, the driver) through Stripe Connect.
5. Prohibited use
You agree not to:
- Place fake, fraudulent, or abusive orders, or use a card you are not authorized to use
- Confirm an order as picked up or delivered before the food is actually handed over, or pressure a customer to do so
- Tamper with, copy, or forge order tokens, prices, or tips, or try to get around the tip rules or the fee rules
- Use the Service for anything illegal, including selling items the law does not allow
- Harass, threaten, or abuse anyone, including through private kitchen notes
- Scrape, overload, probe, or disrupt the Service, or try to get unauthorized access to it
- Copy, resell, or reverse engineer the Service, except as the law allows
- File chargebacks in bad faith, or misuse refunds or the undo window
- Share your account or sign in to someone else’s account, or use a Top Tippers nickname that is offensive or pretends to be someone else
- Claim a directory listing for a restaurant you are not authorized to act for, or post a false or misleading deal
- Copy or reuse the restaurant directory in bulk
We may refuse service, cancel orders, or suspend access if we reasonably believe these terms have been broken.
6. Our content
The TipAfter name, logo, app, and site content belong to Tip After LLC. You may use the Service for its intended purpose only. Feedback you send us may be used to improve the Service without any obligation to you.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” INCLUDING DURING THE PILOT AND IN DEMO MODE. TO THE FULLEST EXTENT THE LAW ALLOWS, TIPAFTER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. RESTAURANTS ARE RESPONSIBLE FOR THEIR FOOD, INCLUDING ITS QUALITY, SAFETY, ALLERGENS, AND PREPARATION. TIPAFTER IS NOT.
8. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, TIPAFTER AND ITS MEMBERS, MANAGERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO TIPAFTER (NOT INCLUDING AMOUNTS PASSED THROUGH TO RESTAURANTS OR DRIVERS) IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100. SOME STATES DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
9. Indemnity
If you use the Service in a way that breaks these terms or the law, and that causes a claim against TipAfter, you agree to cover TipAfter’s reasonable losses and costs from that claim, to the extent the law allows.
10. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Virginia, and you and TipAfter agree to the jurisdiction of those courts. Before filing a claim, please email us so we can try to resolve it informally.
11. Changes and ending use
We may update these terms. We will post changes on this page and update the date at the top. If a change is material, we will give reasonable notice before it takes effect, by email to users who have an account and by a notice on the Service. Continuing to use the Service after changes take effect means you accept them. You may stop using the Service at any time. We may suspend or end the Service, or your access to it, at any time, including when the pilot ends.
12. Related documents and entire agreement
These terms, our Privacy Policy, the Refunds, Cancellations and Disputes page, and the Driver Terms together make up the complete agreement between you and TipAfter about the Service (the “Agreement”). If any of those documents conflict, these Terms of Service control, followed by the Privacy Policy, then the Refunds page, then the Driver Terms. A signed restaurant agreement or letter of intent between Tip After LLC and a restaurant is a separate agreement between those parties and, to the extent it conflicts with these terms on a subject it covers, the signed agreement controls for that restaurant. If any part of the Agreement is found unenforceable, the rest stays in effect. Not enforcing a term is not a waiver. You may not transfer your rights under the Agreement without our consent. We may transfer them as part of a merger, acquisition, or sale of assets.
13. Contact
Tip After LLC, 5226 Alum Spring Rd, Pulaski, VA 24301. Email: hello@tipafter.com
Part B: Customers
14. Ordering and paying
You choose a restaurant, menu items, and pickup or delivery. At checkout you pay for food, fees, and tax only: the menu items, any service fee, any delivery fee, and tax, as shown before you pay. No tip is charged at checkout. Prices are set by the restaurant. TipAfter’s platform fee is paid by the restaurant out of the food charge, not added on top for you.
14.1 Who charges you. Tip After LLC is the merchant of record and charges your card through Stripe. The charge on your card statement will appear as “TIPAFTER” followed by a short form of the restaurant’s name (for example, TIPAFTER* SUNNY SIDE); a tip appears as TIPAFTER* TIP. This is Tip After LLC processing your food order.
14.2 Only restaurants that are ready can take orders. You can place a paid order only with a restaurant whose Stripe payment account is active. If a restaurant is still getting set up, checkout is turned off and you are not charged. TipAfter does not hold diner payments for restaurants that are not set up.
15. The handoff
Each order is confirmed as picked up or delivered only when you actually receive your food: by the restaurant at pickup, or by the driver at delivery. If someone asks you to confirm an order before handing you your food, do not, and tell us.
16. Tips
Tipping is optional.
16.1 Timing. You choose your tip after pickup or delivery is confirmed. You then have 24 hours to tip, skip, choose Tip later, or leave a private note for the kitchen.
16.2 Amount. A tip can be from $0.50 to $200.
16.3 Where tips go. 100% of your tip goes to the people who earned it: the restaurant’s staff tip pool for pickup orders, or the driver for delivery orders. TipAfter takes 0% of tips and covers the card fee on tips.
16.4 Saved card, limited use. When card payments are on, the pay screen asks for your consent before you pay. By paying, you agree that Stripe saves your card for that order so that, if you choose to tip after receiving your order, the tip is charged to that card. The saved card will be charged only for (a) the food payment at checkout and (b) a tip, only if you affirmatively tap a tip amount after pickup or delivery is confirmed. No other charges will be made to the saved card.
16.5 Hard time limit. Your card will not be charged for a tip more than 24 hours after pickup or delivery is confirmed.
17. Undo window and tip finality
17.1 Undo. After you place an order or tap a tip, an Undo button appears for 15 seconds. Undoing an order cancels it and refunds the full amount you paid. Undoing a tip refunds the tip, and you can choose again while the 24-hour window is open.
17.2 Tips are final after the undo window. Once the 15 seconds pass, a tip has gone to the staff or driver and cannot be refunded, except (a) where the law requires otherwise, or (b) when a restaurant refunds the full order under Section 21, in which case the matching tip is also refunded to the customer. A restaurant may not refund a tip on its own without refunding the order. Tips belong to eligible staff and drivers, and may not be diverted by restaurant owners, managers, or supervisors.
18. Problems with an order and refunds
Outside the undo window, if something is wrong with your order (for example, a missing item, the wrong item, or an order that never arrived), contact us at hello@tipafter.com, please within 30 days of the order. We will work with the restaurant to look into it. Whether to give a refund, and how much, depends on the facts and on the restaurant’s policies, and refunds go back to your original payment method. This does not limit any rights you have under the law or under your card issuer’s rules.
19. Private kitchen notes
Instead of a tip, you can send a private note to the kitchen (up to 280 characters). Only that restaurant sees it. It is not a public review. Please keep notes honest and respectful. We may remove notes that break these terms.
Part C: Restaurants
20. Signing up
To join, you give us your restaurant’s details on the sign-up page. You confirm that you are authorized to act for the restaurant and that the details are accurate. When payouts are live, you will set up a Stripe Connect Express account and agree to Stripe’s Connected Account Agreement. Stripe verifies identity and bank details directly. TipAfter does not see or store them.
21. Platform fee
21.1 8% of menu items only. A flat 8% of the menu-item subtotal of each order. There is no separate charge for card processing; TipAfter pays Stripe’s card fees out of the 8%. The fee does not vary by card type.
21.2 No fee on tax, service fees, delivery fees, or tips. TipAfter takes 0% of tips.
21.3 Payouts. The platform fee is taken out of the food charge, and the rest is paid out to your Stripe account on Stripe’s payout schedule. If a customer undoes an order, the matching platform fee is refunded too.
21.4 Sales and meals tax. At sign-up and in your settings you enter one combined rate: state and local sales tax plus any local meals tax you charge. TipAfter adds that rate to the menu subtotal of each order (never to a tip, and never to service or delivery fees), shows it to the customer as a separate line, and passes 100% of it to you with your payout. You are responsible for setting the right rate and for filing and paying the tax. TipAfter gives you a monthly tax report but is not your tax collector or tax advisor.
21.5 Refunds you give. You can refund an order in full or in part from your dashboard. The refunded food amount and the matching tax come back out of your Stripe balance. When you refund a full order, the matching tip is also refunded to the customer (see Section 17.2). A partial refund does not affect the tip. Stripe does not return its card processing fee on a refund, and you cover that fee on the refunded part. TipAfter returns the matching part of its platform fee minus that card fee; if the card fee is larger, the difference is taken from your Stripe balance. Each refund screen and your monthly report show the amount.
21.6 Fee changes. We will give at least 30 days’ notice before changing the platform fee.
22. Tips belong to your staff and drivers
Pickup tips go to your restaurant’s staff tip pool. Delivery tips go to the driver. You agree to distribute 100% of pooled tips to eligible employees as the law requires, including the federal Fair Labor Standards Act and Virginia law. Owners, managers, and supervisors may not take any part of the tip pool. Tips are on top of wages and may not replace them, except as the law allows.
23. Your responsibilities
You agree to:
- Keep your menu, prices, hours, and pickup and delivery options accurate
- Prepare food safely and lawfully, and hold any permits and licenses you need
- Accept orders promptly and mark them ready
- Confirm pickup only at the real handoff, and never mark an order handed over early
- Handle food complaints with customers in good faith
- Comply with laws that apply to your business, including tax, labor, and food safety laws
- Keep your kitchen screen and any connected register secure
You agree to indemnify and hold Tip After LLC harmless from claims arising from the food you prepare, sell, or deliver through TipAfter, including food safety, allergens, and preparation, to the extent allowed by law.
24. Register (point-of-sale) connections
If you connect a register system, you authorize TipAfter to exchange menu, order, and order-status data with it as needed to run orders. Tips are never sent to the register. You may disconnect at any time.
25. Local deals and coupons
Where the local deals feature is available, you may post specials and coupons for diners who opted in to TipAfter’s weekly local deals emails. Every deal is reviewed by TipAfter before it appears, and we may decline or remove any deal.
25.1 Prohibited deal content. Deals for alcohol, tobacco or vaping products, cannabis or CBD, or other age-restricted products are not allowed.
25.2 Your responsibility. You are responsible for the accuracy of each deal and for honoring it as written, including its dates and terms. Each deal must include an expiration date and any material limits or conditions (for example, “while supplies last” or “limit one per customer”).
25.3 Customer data. TipAfter sends deals emails only to diners who opted in, and you never receive or can export diners’ names, email addresses, ZIP codes, or other customer data. You see totals only, such as how many opted-in diners are nearby and how many times a deal was viewed or redeemed.
25.4 Deals indemnity. You agree to indemnify and hold Tip After LLC harmless from claims arising from the content, accuracy, or fulfillment of a deal you post, to the extent allowed by law. TipAfter’s review of a deal before publication does not make TipAfter responsible for its accuracy.
26. Ending
You may stop using TipAfter at any time. We may suspend or end your access if these terms are broken, if Stripe stops supporting your account, or when the pilot ends. Amounts already owed to you for completed orders will still be paid out through Stripe. Sections 7 (Disclaimers), 8 (Limitation of liability), 9 (Indemnity), 10 (Governing law and disputes), 22 (Tips belong to your staff and drivers), 23 (Your responsibilities, including the food indemnity), and 25.4 (Deals indemnity) survive the end of these terms.
Part D: Drivers
27. Driver terms
Drivers who deliver TipAfter orders are independent contractors, not employees of Tip After LLC. Separate draft Driver Terms apply to drivers: see tipafter.com/drivers. Delivery with real payments is not live yet.
Part E: Accounts, Top Tippers, directory, and waitlist
28. Customer accounts
28.1 Accounts are optional. You can browse and order as a guest. If you create an account, you give us your email, your name, a password, and, if you choose, a phone number, and we keep your order history so you can see it. You must be at least 18 (or the age of majority where you live) to create an account.
28.2 Keep your account secure. Use a password you do not use elsewhere, do not share your account, and tell us right away at hello@tipafter.com if you think someone else has used it. You are responsible for activity in your account that you allowed or failed to prevent by keeping your credentials secure.
28.3 Staying signed in. A sign-in cookie keeps you signed in for up to 30 days unless you sign out. See the Privacy Policy for details about how account data is stored and protected.
28.4 Closing an account. You can ask us to close your account at any time by emailing hello@tipafter.com. We will delete your account details (email, name, phone, password hash, and nickname) and your Top Tippers records within 60 days of your request. Order and payment records tied to your account are kept for three years from the order date for tax, accounting, and dispute purposes, as described in our Privacy Policy. We may also suspend or close an account that breaks these terms.
29. Top Tippers board
29.1 Opt-in only. The board is off unless you turn it on in your account, and you can turn it off at any time.
29.2 What is shown. When it is on, the board shows only your nickname, rank, badge, and your best tip that day as a whole-number percent of the food total. It never shows your real name, the restaurant, or dollar amounts. Only picked-up orders with at least $10 of food count.
29.3 Bragging rights only. There is nothing to win. No money, discount, or anything else of value is given for being on the board, and tipping is always up to you.
29.4 Nicknames. Nicknames must be respectful and may not use your real name, your email, someone else’s name, or words we reserve. We may change or remove a nickname, or remove anyone from the board, at our discretion.
29.5 Records and deletion. Your Top Tippers records (nickname and daily tip percent entries) are kept with your account. Turning the board off removes you from today’s board right away. Records for earlier days are kept until your account is closed or you ask us to delete them, whichever comes first. See the Privacy Policy for full retention details.
30. The free restaurant directory
30.1 What the directory is. The directory lists local restaurants by region (Savannah, Georgia and Southwest Virginia). A restaurant marked “Not on TipAfter yet” has not joined TipAfter and is not affiliated with or endorsing TipAfter. Its listing shows only public business facts and has no ordering.
30.2 Listing accuracy. Listing details come from public sources and may be out of date. Please check with the restaurant before relying on them. Southwest Virginia listing data is copyright OpenStreetMap contributors and available under the Open Database License (ODbL).
30.3 Claiming or removing a listing. Restaurant owners can claim a listing for free, or ask us to correct or remove it, at hello@tipafter.com. A claimed listing changes only after TipAfter approves it, and we may ask for proof that you are authorized to act for the restaurant. Online ordering at 8% of menu items is optional (see Part C).
30.4 “Tell them you want online ordering.” You can tap this on a listing that is not on TipAfter yet. It is anonymous unless you choose to give your email for a one-time notice when that restaurant starts taking orders. See the Privacy Policy for how this information is stored and deleted.
31. Waitlist and email from TipAfter
31.1 Waitlist. You can join the waitlist as a diner or a restaurant owner. Joining is free and does not require you to accept marketing email.
31.2 Marketing email. We send marketing email (launch news, local deals, or a directory notice) only if you ticked the box for it. Every marketing email comes from Tip After LLC, includes our mailing address (Tip After LLC, 5226 Alum Spring Rd, Pulaski, VA 24301), and has a one-click unsubscribe link. Order receipts and order updates are not marketing email.
31.3 No text messages. TipAfter does not send text messages today. If that changes, we will update these terms and our Privacy Policy and ask for your separate consent before sending any marketing text.
31.4 Data practices. See our Privacy Policy for what information the waitlist collects, how it is stored, how long it is kept, and your rights regarding that information.
